We also use the terms "you," "your" or "yours" to refer to Customer herein. The terms "we," "us" or "our" refer to Parrot Mobile LLC and its affiliates.

Parrot Mobile may change or modify the Terms and Conditions from time to time without notice other than posting amended Terms and Conditions on this Website.Parrot Mobile reserves the right to change, modify or discontinue, temporarily or permanently, the Website (or any portion thereof), including any and all content contained on the Website, at any time without notice. You agree that Parrot Mobile shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Website.

Active Phones & Phone Numbers

If a Customer enrolls a new SIM on a line with an existing active number, the Parrot Mobile Service will no longer be active on the previous SIM enrolled on that line and will be available only on the newly enrolled SIM. An active number can only be connected to one SIM, so Parrot Mobile Customers can only enjoy the Parrot Mobile Service on one single SIM per line.

When a line is no longer active, Parrot Mobile will re-assign the phone number associated with that line, and that phone number may no longer be available to the previous account holder, unless the Customer has ported the number to a third-party carrier consistent with applicable law and Parrot Mobile policies.

Billing Policy

All sessions (data, calls) are debited directly from your balance (Plan or Pay As You Go) as soon as the records for the sessions are available from our providers. Taking this into account, delays in charges may appear. Whatever the delay, charges will be deducted from the available balance (Plan or Pay As You Go) or, if the balance is not enough, as soon as the account balance gets updated (Plan renewal, Plan purchase or Pay As You Go Top Up).

You acknowledge and agree that the rates for any Service, including Service to or from any country, may change from time to time, and that such changes will be reflected in the charges that are deducted from your account balance.

Billing Cycle

You agree to pay all charges we bill you or that were accepted or processed through your Device. All Parrot Mobile LLC Service plans are measured on 30-day monthly cycles (including for purposes of determining your data usage levels).

We may offer you the opportunity to set up automatic payments through the method of payment on your account, which payments will be automatically charged at the end of your applicable payment cycle ("Auto Renew"). When you enroll in Auto Renew, automatic payments for plan fees that you incur will continue until you cancel. The recurring charge may vary if you change your plan or we change our prices, following notice to you.

You may cancel Auto Renew or review your payment preferences at any time by managing your account preferences on the Parrot Mobile website. You must change your Auto Renew preferences or cancel 24 hours prior to the end of your payment cycle in order for the change to go into effect. No minimum purchase is necessary to enroll in Auto Renew.

Wi-Fi E911 Disclosure

This Disclosure informs Parrot Mobile LLC customers of differences between the 911 and E911 access capabilities available with the Parrot Mobile LLC Wi-Fi calling service (the "Wi-Fi 911 Service") and the 911 and E911 access capability available with traditional wired telephone service. It is important that you understand how these differences affect your ability to access 911 and E911 services.

PLEASE CAREFULLY READ THE INFORMATION BELOW. IT CONTAINS IMPORTANT INFORMATION REGARDING LIMITATIONS OF 911 FUNCTIONALITY. YOU ACKNOWLEDGE THESE LIMITATIONS AND AGREE TO SHARE THESE LIMITATIONS WITH ANYONE WHO MAY USE YOUR SERVICE TO PLACE CALLS OR SEND TEXTS.

911 services are provided by your state and local government. Parrot Mobile LLC handsets are capable of making calls to 911 in the United States, and 911 access is available to customers regardless of your Rate Plan. The handset must have battery power and network connectivity to complete a 911 call.

Although Parrot Mobile LLC is often capable of communicating your phone number and/or current location to a public safety answering point ("911 Communications Center"), in some cases, 911 Communications Center operators may not know your phone number or have information about your current location. As a result, when making 911 calls, you should provide your contact information and current location.

Wi-Fi 911 service is dependent on a functioning Wi-Fi connection. Without a Wi-Fi connection, the Wi-Fi 911 service will not work. Wi-Fi 911 service will not operate during power outages or if your Wi-Fi connection is disrupted. In case of emergencies, it is recommended that customers have a redundant or backup internet connection, an uninterruptible backup power supply, and/or a landline telephone.

Neither Parrot Mobile LLC nor its network supplier is responsible or liable for anything related to your use of or inability to use any Wi-Fi calling made available to you, including, without limitation, any failure of emergency calls (whether 9-1-1 calls or otherwise).

Acceptable Use of Service

When joining Parrot Mobile, you also agree to comply with our usage policy. You may use our Service for:

  • Voice calls
  • Web browsing
  • Sending and receiving messages and emails
  • Uploading and downloading applications and content
  • Streaming music
  • Sharing your data with other devices pursuant to the allotments of your Data Plan

We prioritize smartphone and mobile internet (tablet) over Smartphone Mobile HotSpot (tethering) traffic on our network. We may limit the number of devices that can be tethered. The Service cannot be used to establish a continuous, unattended connection. Parrot Mobile may take any reasonable action which it deems in its sole discretion to be a potential threat to its network or other users, including limiting or terminating tethering/hotspot.

Prohibited Uses Include:

  • Illegal, abusive, threatening or fraudulent purposes.
  • Providing altered, deceptive, or false information about the identity of the sender.
  • Sending mass unsolicited email (SPAM) or other types of abusive communications.
  • Uses which consume disproportionate amounts of network capacity.
  • Actions generating unusually high usage (e.g., more than 50GB/month with majority used for HotSpot during any 3 billing cycles within a 6-month period).
  • Reselling the Service, either alone or as part of any other good or service.
  • Tampering with or modifying your device to circumvent policies.

We reserve the right to act immediately and without notice to restrict, suspend, or terminate your use of the Service in case you have disregarded the rules above. No refunds will be provided if the service is terminated for violation of the acceptable use policy.

Network Management

Generally, Parrot Mobile does not inhibit the ability of our Customers to use mobile data. However, like many service providers, Parrot Mobile employs reasonable network management practices consistent with industry standards to maintain the reliability of its network and minimize network issues and complications.

Specifically, Parrot Mobile currently manages its network in the following ways: Traffic identified as malicious (such as distributed denial of service attacks) may be automatically identified and blocked. In the event of network congestion in which the supporting technology determines that Service is likely to be degraded for Customers, Parrot Mobile manages its network resources to prioritize certain communications in order to avoid disruption of those Services. Otherwise, network management is non-discriminatory and agnostic to the application.

Termination of Service

WE RESERVE THE RIGHT TO ISSUE A WARNING OR TO SUSPEND OR EVEN TERMINATE YOUR SERVICE AND ACCESS TO OUR WEBSITE OR APP IF WE DETERMINE YOU HAVE VIOLATED ANY OF THE TERMS OF SERVICE LISTED ON THIS PAGE OR IN ANY SERVICE DOCUMENT, ANY OF THE RULES OR POLICIES APPLICABLE TO THE USE OF THIS SITE, OR FOR ANY OTHER REASON.

SIM and eSIM

Unless specifically stated otherwise on our website, the Service is available only for persons located within the United States (excluding Puerto Rico).

Physical SIMs: Parrot Mobile physical SIM kits are sold exclusively through authorized retailers (e.g., Amazon). Please refer to the retailer's shipping and delivery policies. SIMs must be activated by the Customer in the Parrot Mobile online account within 30 days from purchase.

eSIMs: Parrot Mobile eSIMs are available only on select compatible and eligible unlocked devices, and only with certain plans, at specific times, as determined solely by Parrot Mobile. Device compatibility, eligibility, and eSIM availability may change at Parrot Mobile's sole discretion.

Pay As You Go Service Agreement

Pay As You Go credit is available for a period of 90 days since Customer's last Pay As You Go order. If no order was placed in a period of 90 days, Pay As You Go credit will expire and the Parrot Mobile Service will be disconnected.

The minimum Pay As You Go credit purchase is $20.00.

Calls are billed in increments of one minute, with fractions thereof rounded up to the next minute. If data usage is turned ON in Customer's online account, all data sessions will be charged first from an active plan containing data. Only when the data balance of the plan is zero will data sessions be charged from the existing Pay As You Go balance. Data usage is rounded up to the next full-kilobyte increment at the end of each data session.

All sales are final. Balances once credited are non-refundable, non-transferable and non-exchangeable.

International Roaming Service Agreement

Customers may use international roaming to make calls, send SMS, and access data when traveling outside of the U.S. International roaming service is only available in select countries and exclusively with Pay As You Go credit. Customers without a Pay As You Go balance cannot access this feature.

Customers need to activate international roaming by turning this feature to "ON" in their account Settings. If a Customer makes calls, sends text, or uses data when traveling in a country where international roaming is available, costs of this usage will be automatically deducted from the Customer's Pay as You Go balance.

Plans Service Agreement

Plans are subscriptions purely designed for residential usage. If you subscribe to one of our plans we will provide the Service solely to you for normal residential, non-commercial use.

Plans will be automatically renewed every 30 days, unless a Customer decides to change or renew a plan during the billing cycle. The monthly fee is non-refundable. If automatic billing fails to pay the charges on your account in full on the second attempt, your Services may be suspended or terminated.

Any unused balance of the plan will expire once the usage period is over. Parrot Mobile reserves the right to expire numbers that no longer have an active plan.

Prepaid multi-month plans are not contracts - you are simply prepaying for service at a discounted rate. You may cancel at any time, though prepaid amounts are not refundable.

Prepaid Multi-Month Plans

When you select a multi-month plan (3, 6, or 12 months), you are prepaying for the entire term upfront at a discounted rate. Your service will continue at the same rate for the duration of your chosen term. At the end of your prepaid term, your plan will automatically renew at the then-current rate unless you cancel or change your plan before renewal.

Plan Changes - Upgrades

You may upgrade to a higher-tier plan at any time. The unused value from your current billing period is calculated on a day-prorated basis (based on what you actually paid) and credited toward your new plan. You pay only the difference between this credit and your new plan price. Upgrade credits apply toward the new plan only and are never paid out as cash or transferred to account balance.

Plan Changes - Downgrades

Downgrades take effect at your next renewal date. You will continue on your current plan until then. No partial refund is issued for the remaining time on your current plan. You may cancel a scheduled downgrade at any time before it takes effect.

Refunds and Cancellations

Prepaid multi-month plan payments are non-refundable on a prorated cash basis. If you cancel service mid-term, remaining prepaid months will not be refunded. Unused value may only be applied as credit toward an upgrade as described above. We may, at our sole discretion, evaluate refund requests on a case-by-case basis for exceptional circumstances.

Renewal and Billing Cadence

Your carrier-side service renews monthly regardless of your prepaid billing term. Monthly billing is suppressed during an active prepaid term and resumes at term end. You will receive a renewal reminder before your term expires. Rates at renewal may differ from your original term rate.

Plan Change Limits

To maintain service quality, plan changes are subject to a minimum waiting period between changes and cannot be made within 24 hours of your renewal date. These limits apply to customer-initiated changes only.

Introductory Rate Disclosure

Some promotional offers provide an introductory rate for a limited term. At the end of the introductory period, your plan will automatically renew at the standard rate for your selected term length unless you change your plan before renewal.

Porting Policy

Parrot Mobile does not charge any fees for porting your number out to another carrier. You must have an active Parrot Mobile account to port your phone number. If you cancel your service before porting is complete, you may lose your number.

Taxes, Surcharges & Fees

In addition to the charges billed for Parrot Mobile Services, surcharges, taxes, fees, and other charges may be applied to your invoice based on the type of service you have, and your geographical location. By shopping on this site, the Customer agrees to pay all applicable federal, state, and local taxes, surcharges or fees required or permitted to be billed by Parrot Mobile.

  • Federal Universal Service Fund (FUSF): Helps provide affordable service to low-income consumers, schools, and rural areas. This is a permissible pass-through surcharge.
  • State & Local Regulatory Surcharges: May include State Universal Service Funds (SUSF) and Telecommunications Relay Services (TRS) Funds.
  • Sales and Use Tax: Imposed by state and local jurisdictions on the sale of services.
  • E911 Fees: Imposed by state and local jurisdictions to fund emergency telephone services.
  • Federal Cost Recovery Fee: A permissible pass-through surcharge assessed at a rate set by the Federal Communications Commission (FCC) to fund the Telecommunications Relay Service (TRS). The amount is calculated based on the FCC's current contribution factor applied to interstate and international service revenue - not set by Parrot Mobile.

Refunds

Service Refunds: If the Customer is unable to use any of the plan's purchased balances (minutes, data) due to a service activation failure, network incompatibility, or other issue attributable to Parrot Mobile, a full refund of the plan's value will be offered provided the request is made within the first billing cycle. Partial refunds for unused plan balances may be offered on a case-by-case basis.

Pay As You Go Refunds: Refunds are available for a period of 90 days from Customer's last order. If no order was placed within 90 days of purchase, Pay As You Go credit will expire. Balances older than 5 months are not eligible for refunds.

SIM Cards: SIM cards purchased via third-party retailers (e.g., Amazon) are subject to the retailer's return and refund policies. Parrot Mobile does not directly refund SIM card purchases.

Dispute Resolution and Arbitration

BY ACCEPTING THESE TERMS AND CONDITIONS, YOU ARE AGREEING TO RESOLVE ANY DISPUTE WITH US THROUGH BINDING ARBITRATION AND TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION SUIT.

Any dispute shall be governed by the laws of the State of Delaware, excluding its principles governing choice of law. Any action concerning a dispute shall be brought in the courts located in Delaware.

Service Accessibility

The Referral Program is offered at Parrot Mobile's sole discretion and may be modified, suspended, or terminated at any time without notice.

Referral Credits. Referral credits are applied as account credit toward your monthly Parrot Mobile service invoice. Credits have no cash value, are non-transferable, non-refundable, and cannot be applied to prepaid international calling or roaming balances. All credits are forfeited upon account closure.

Timing. The Referred customer's credit will be awarded by the next business day following line activation, provided the Referrer has active Parrot Mobile service at that time. The Referrer's credit will be awarded after the qualifying period (currently three paid billing cycles), provided both the Referrer and the Referred customer maintain active Parrot Mobile service throughout that period.

Eligibility. The Referral Program is available only to:

  • New customers activating their first line on a new Parrot Mobile account.
  • Customers located in the United States.
  • One referral code may be used per order. The referral code must be applied at checkout.
  • Both the Referrer and the Referred must have active Parrot Mobile service for credits to be awarded.

Clawback & Holdback. Credits may be reversed if the referred line is cancelled or refunded within the holdback period. Annual and lifetime caps on referral credits may apply as specified in the program details.

Anti-Fraud. Parrot Mobile reserves the right to void any referral and reverse associated credits at its sole discretion if it determines that the referral involved abuse of the program, including but not limited to self-referrals, fraudulent or duplicate accounts, or any violation of these Terms and Conditions.

The Referral Program is subject to these Terms and Conditions and all applicable laws. Parrot Mobile reserves the right to determine eligibility and resolve any disputes arising from the program.
